Nectarweb – Terms of Service
1) Acceptance of Terms
By signing up for or using any Nectarweb service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
2) Services
Nectarweb provides the following services on a best-effort basis and subject to availability:
- Web hosting and domain registration
- DNS and cPanel hosting
- Website development and related support
- SSL certificates
- E-mail hosting
- Custom technical solutions
Notes: Nectarweb is a reseller; upstream infrastructure and registries are operated by third parties (e.g., BinaryLane, Synergy Wholesale). We do not provide a formal SLA or service credits. Uptime is typically excellent with upstream providers; maintenance windows and incidents may occur.
3) Client Responsibilities
- Keep your contact and billing information accurate.
- Secure your login credentials and use strong passwords.
- Use services only for lawful purposes and comply with applicable laws (including Australian law).
- Maintain your website software, configurations, and content.
You must not use our services to host or distribute:
- Malware or malicious content
- Illegal or infringing material
- Spam or unsolicited messages
- Activities that disrupt or abuse shared infrastructure
4) Payment and Billing
- Payment is required in advance of service delivery unless otherwise agreed.
- Services may be suspended or terminated for non-payment.
- Payments are processed by Stripe/PayPal; Nectarweb does not store full card numbers.
- No refunds for unused hosting time. This does not limit your rights under the Australian Consumer Law (ACL).
Auto-billing (optional): If you enable direct debit or card-on-file, recurring charges will be processed automatically per your plan/renewal settings.
5) Uptime and Support
- We aim for reliable service (commonly 99%+ upstream uptime) but offer no formal uptime guarantee or credits.
- Planned maintenance may occur; where practical, we will provide notice.
- Support is provided via the ticket system (best-effort response; no guaranteed response time).
- Compatibility with all third-party applications, plugins, or scripts is not guaranteed.
6) Data and Backups
- You are responsible for your own backups.
- Upstream infrastructure (e.g., BinaryLane) performs daily backups as part of their platform; these are courtesy backups and not guaranteed.
- If we developed and host your site, we may keep development backups; this is not a guaranteed service.
- You may request an export or copy of your site/data via support; fees may apply for manual exports or large datasets.
7) Intellectual Property & Portability
- Your content remains yours. You own the text, images, and materials you provide.
- Deliverables: You own the final compiled deliverables (e.g., built site, WordPress instance, database export).
- Frameworks & source: Nectarweb retains rights to underlying frameworks, reusable components, internal tooling, or source used to build your site/app. You may migrate your compiled site; redistribution of Nectarweb’s proprietary source/templates requires written permission.
- Domains: Domain registration is subject to registry/ICANN rules; WHOIS privacy may be available depending on TLD.
8) Account Termination
- We may suspend or terminate services for breach of these Terms, non-payment, illegal activity, or activity that risks service for others.
- You may terminate services at any time via the WHMCS client area or by contacting support.
Data handling and deletion timelines follow our Privacy Policy and operational procedures.
9) Limitation of Liability
To the maximum extent permitted by law, Nectarweb is not liable for indirect, incidental, special, consequential, or punitive damages (including data loss or business interruption). Nectarweb’s total liability for any claim relating to the services is limited to the fees you paid for the impacted service in the 30 days prior to the event giving rise to the claim. Nothing in these Terms limits your non-excludable rights under the ACL.
10) Changes to Terms
We may update these Terms from time to time. We will update the “Effective Date” and, where practical, notify you of significant changes. Continued use of the services after changes means you accept the revised Terms.
11) Governing Law & Disputes
These Terms are governed by the laws of Queensland, Australia, including the Australian Consumer Law. Disputes will be handled in the courts and tribunals of Queensland, subject to any mandatory consumer protections.

Keep your details secure, don’t host anything illegal, and keep your own backups (our upstreams may keep daily backups but they’re not guaranteed).
